These Terms and Conditions (“Terms”) govern the purchase of activities with Action Flight (“we”, “us”, or “Action Flight”), and include terms & conditions of use of Xola (https://xola.com/terms). Please read all these Terms carefully before submitting your Order for any Action Flight activity. By submitting your Order, you agree to be legally bound by these terms.
Please indicate that you UNDERSTAND AND AGREE to the following:
AEROBATIC FLIGHT
Aerobatic flights are a weather-dependent sport. Action Flight has the right to cancel operations due to unsuitable weather conditions.
Your aerobatic flight ticket is valid for 12 months from the date of purchase, but confirmation of booking date must be made via Action Flight’s website.
For aerobatic flights, Action Flight requires you to be at or below our height and weight requirements.
Max. height: 1.93m/6’4”
Max. weight: 110.0 kg/240 lbs
You must be at least 12 years or older (according to the Gregorian calendar) on the day of your activity, have parental consent and must be capable of following pilot instructions and getting in and out of the aircraft unassisted.
If you are 70 years old or older on the day you skydive, you must self-certify that you are physically able to undertake this activity.
There must be no alcohol or drugs in your system 24 hours before a participate in your chosen activity.
You should not scuba dive 24 hours before the date of your flight.
Due to the fact the aerobatic aircraft will depart from RAK International Airport, YOU MUST BRING YOUR VALID PASSPORT.
PLEASE NOTE THAT THE PILOT IN CHARGE HAS THE FINAL ABSOLUTE DISCRETION TO REFUSE TO PERMIT ANY PERSON IF IN HIS OPINION THAT PERSON MAY BE A DANGER TO THE FLIGHT, SUCH AS PEOPLE WHO FAILED OR WERE UNABLE TO FOLLOW SAFETY INSTRUCTIONS OR IF A PERSON IS PHYSICALY UNABLE TO PERFORM SAFETY PROTOCOLS (BRACE POSITION ETC).
FOR SKYDIVE ACTIVITY
Skydiving flights are a weather-dependent sport. Action Flight has the right to cancel operations due to unsuitable weather conditions.
Your Skydive ticket is valid for 12 months from the date of purchase, but confirmation of booking date must be made via Action Flight’s website.
For Sky Diving, Action Flight requires you to be at or below our weight and BMI requirements.
Women – Weight: 90.0 kg/ 198.0 lbs or less. BMI: 27.5 or less.
Men – Weight: 100.0 kg/220 lbs or less. BMI: 30.0 or less.
You must be at least 12 years or older (according to the Gregorian calendar) on the day of your activity, with parental consent and capable of following tandem master’s instructions.
If you are 70 years old or older on the day you skydive, you must self-certify that you are physically able to undertake this activity.
There must be no alcohol or drugs in your system 24 hours before a participate in your chosen activity.
You should not scuba dive 24 hours before the date of your tandem skydive.
Due to the fact the sky dive aircraft will depart from RAK International Airport, YOU MUST BRING YOUR VALID PASSPORT.
PLEASE NOTE THAT THE PILOT IN CHARGE HAS THE FINAL ABSOLTE DISCRETION TO REFUSE TO PERMIT ANY PERSON IF IN HIS OPINION THAT PERSON MAY BE A DANGER TO THE FLIGHT, SUCH AS PEOPLE WHO FAILED OR WERE UNABLE TO FOLLOW SAFETY INSTRUCTIONS OR IF A PERSON IS PHYSICALY UNABLE TO PERFORM SAFETY PROTOCOLS (BRACE POSITION ETC).
FOR BALLOON ACTIVITY
Hot air balloon flights are a weather-dependent sport. Action Flight has the right to cancel operations due to unsuitable weather conditions.
Your balloon ticket is valid for 12 months from the date of purchase, but confirmation of booking date must be made via Action Flight’s website.
For ballooning, Action Flight requires you to be no more than 130kg (286lbs) in weight
You must be at least 5 years or older (according to the Gregorian calendar) on the day of your activity. In you are under 16 years of age, must be accompanied by a parent or guardian.
If you are 70 years old or older on the day you skydive, you must self-certify that you are physically able to undertake this activity.
If you are pregnant 3months or more on the day of your flight, you are not permitted to fly.
There must be no alcohol or drugs in your system 24 hours before a participate in your flight.
You should not scuba dive 24 hours before the date of your flight.
Due to the fact the sky dive aircraft will depart from RAK International Airport, YOU MUST BRING YOUR VALID PASSPORT.

GENERAL INFORMATION
When placing an Order for one of Action Flight’s activities, you will be required to provide certain information, as such as your address and billing information, as well as personal health and medical details. You represent and warrant that all such information is accurate, and you shall ensure that such information is kept current.
Action Flight will not issue refunds. You are entitled to rebook your activity withing 12 months of the purchase date of the Ticket. If you are unable to take up the activity for any reason, you may get in touch with Action Flight booking center and transfer the voucher to a 3rd party. Information on that 3rd party will need to be taken to ensure correct transfer.
All passengers, as part of the activity purchase, must self-certify that they are medically fit to undertake the activity.
LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES WILL ACTION FLIGHT BE HELD LIABLE FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OR RELATED TO THIS AGREEMENT. IN THE EVENT ACTION FLIGHT IS HELD LIABLE FOR ANY DAMAGES ARISING OUT OR RELATED TO THIS AGREEMENT, YOUR SOLE AND EXCLUSIVE REMEDY WILL BE THE FULL REFUND OF YOUR PURCHASE PRICE WITHOUT INTEREST.
Your personal data shall be held by Action Flight in its automated filing systems. You hereby consent to the processing and disclosure of such personal data internally and so far as is reasonably necessary externally, for decisions to be made regarding your chosen activities, regulatory or legal processing, and marketing. You further consent to Action Flight processing and disclosing sensitive data internal and externally to professional advisers in confidence or to medical practitioners, including medical information for the purpose of assessing your ability to undertake a chosen activity.
Action Flight reserves the right to change any of the terms for any or no reason. We will provide notice of any material changes and, if you are unhappy with such changes, your sole and exclusive remedy will be to transfer your reservation as described above.
Subject to Regulatory Approval. This voucher is subject to and will not become effective until Action Flight has received all necessary regulatory approvals, including the approval of an Air Operators Certificate granted by the UAE General Civil Aviation Authority.
AEROBATIC DECLARATION OF FITNESS
ACTIONFLIGHT RAS AL KHAIMAH
I hereby declare that I am physically fit. I do not, and have not, suffered from any of the following conditions, which I understand may lead to a dangerous situation with regard to myself or other persons during aerobatic flight activity*/I have had one of the following conditions and have declared full details to the certifying doctor*:
Epilepsy, fits, severe head injury, recurrent blackouts or giddiness, disease of the brain or nervous system, high blood pressure, heart or lung disease, recurrent weakness or dislocation of any limb, diabetes, mental illness, drug or alcohol addiction.
I further declare that I am not pregnant and also that in the event of contracting or suspecting any of the above conditions, or in the event of sickness absence over twenty consecutive days, incapacitating injury or confirmation of pregnancy, I will cease to participate in any aerobatic flight activity until I have obtained medical approval. I have read the notes below.

PERMISSION FROM A MEDICAL PROFESSIONAL AND PRESENT THE DOCTOR’S CERTIFICATE BELOW BEFORE PARTICIPATING. DOCTOR’S CERTIFICATE
The preferred level of skill of the certifying doctor is usually that of a GP without specialist knowledge of aerobatic flights but usually with access to the candidate’s records or a specialist responsible for the patients care. Other doctors completing the certificate should remain aware that lack of access to the medical record could result in important conditions being overlooked.
A certifying doctor is not stating that a participant will remain free of injury during aerobatic flights, but that records, history or appropriate clinical examination have not suggested unacceptable medical risk factors.
I understand that the applicant wishes to take an aerobatic flight but has a listed condition/is aged 70 or over*. I have read the notes below. In my opinion as a qualified doctor without specialist knowledge of aerobatics, the participant is physically and mentally capable of participating in aerobatic flights and is medically safe to do so.

NOTES FOR AEROBATIC PARTICIPANTS – No persons under the age of 12 is permitted to participate in aerobatic flights. Aerobatic flight participants do not have to be particularly fit but there are some medical conditions that can cause problems. As well as the conditions listed above, the following may cause problems to participants. If you have ever suffered from any of them, you must have your doctor’s approval before undertaking a flight: Previous back strain, asthma, rheumatic fever, pneumothorax, liver or kidney disease, anemia, thyroid, adrenal or other glandular disorder, chronic ear, or sinus disease. Any condition which requires the regular use of drugs. Regular or recent blood donations.
Blindness is no barrier to aerobatics. However, if you do wear spectacles they should be securely attached while participating.
NOTES FOR DOCTORS
Cardiorespiratory fitness is important. Aerobatic flights make rapid flight movements whereby participants experience both positive and negative G-forces as well as possible special disorientation. A tachycardia of 120 – 160 bpm is common in experienced aerobatic practitioners and 200 bpm is not unusual in novices. Ischemic heart disease, uncontrolled hypertension and cerebrovascular disease are absolute contraindications. The examining doctor should be satisfied that any impairment will not cause respiratory embarrassment at altitude. A history of autonomic dysreflexia should be excluded in participants with spinal injuries above mid-dorsal level. Specialist advice should be sought in cases of doubt.
Participants are strapped into a cockpit seat throughout the flight. Musculoskeletal fitness is not required and even paralysis or partial amputation of limbs is acceptable provided the Pilot in Charge secures flaccid limbs before the commencement of a flight. During the aerobatic flight the Participant may experience about 4Gs. Unstable spinal injuries may be exacerbated by such pressures.
Middle ear or sinus disease/infection may cause problems due to the rapid changes in ambient air pressure. The rate of assent and/or descent is short lived and range of 3,000-5,000 feet above sea level.
Neither blindness or deafness constitutes a barrier to participation, but the participant must be capable of appreciating what is happening and of giving informed consent. Stable diabetes with no tendency to hypoglycaemia is acceptable. Epilepsy is not a contraindication provided that control is good and there have been no fits or changes in medication in the last two years. Most neurodegenerative disorders are acceptable unless respiratory impairment or marked postural hypotension are present.
Normal mental development and a stable mental state are important. The participant must be able to understand what he/she is about to do and be capable of giving fully informed consent. The participant’s behavior must not pose a risk to the aircraft or the pilot. Current neurosis requiring active treatment, history of psychosis, sub normality, pathological euphoria, drug addiction and alcohol dependence all constitute a contraindication.
